A law cannot unduly burden a fundamental right unless it prohibits a benefit one is entitled to. Otherwise, we simply have another tough choice in life. The cohabiting couples in Cole may have been "eligible" to adopt, but they were not "entitled" to adopt. Unlike the seventh day adventist who was eligible AND ENTITLED to unemployment benefits, no one is entitled to adopt--even if they are "eligible" to adopt. Nor does anyone have a constitutional right or fundamental need to adopt a child. Fundamental "need" differs from a fundamental "desire." Adopting, unlike putting food on one's table, is not so vital that one cannot live in liberty without it. The parties in Cole had only wishes and desires to adopt. No one owed them an adoption. The proper claim is one of equal protection, not the undue burden of a fundamental right. The Cole ruling is a perversion of constitutional law.Erik L. There are two reasons why I think th...Hi Michael -<br /><br />There are two reasons why I think this latest cert petition is weak:<br /><br />1) Interlocutory appeals of discovery orders are strongly disfavored, and the documents at issue have already been entered into evidence, so whatever harm may occur in this case has already occurred; and <br /><br />2) Much of the cert petition is framed as a claim that the 9th Circuit's ruling will open litigation floodgates, change campaigns forever, etc. I think that the opp cert should be able to paint this case as quite narrow and particular.<br /><br />As a result, I don't see the need for the Court to engage with this issue now, which is why I think the cert petition is weak. The underlying questions, however, are important, so I don't disagree that the Court might reach them in the future, perhaps even as dicta in Doe v. Maybe you should just start ove...Where to begin...<br /><br />Maybe you should just start over with this post. <br /><br />The facts are this, the "Colorado Civil Union Benefits and Responsibilities Act" was indeed filed back in 2009, however, from there the entire post goes off. The article you link to from the Denver Daily News (also errored, which is why you should have double checked the information) was talking about a marriage initiative filed in 2010 to change our constitution allowing same-sex couples to marry. <br /><br />"Coloradans For Family Equality" was the organization pushing the initiative from last year, and I'm not sure if there is an equivalent organization pushing the marriage initiative from this year, but that's certainly not their name.
