Department of Justice files opposition to motion for summary judgment in Gill v. OPM

Brief by Dept. of Justice supporting its motion to dismiss and opposing plantiffs' motion for summary judgment, filed 01/29/10, in Gill et al. v. Office of Personnel Management [No. 1:09-cv-10309-JLT, (U.S.Dist.Ct., D. Mass.)

(Thanks to California attorney Rick Xiao for alerting to me to today's filing.)

Plaintiffs in this case challenge section 3 of the federal DOMA, which bars the federal government from recognizing the marriages of same-sex couples. As a result, married, same-sex couples are ineligible for over 1100 federal benefits.

I expect to update this post.

Hi Michael,

Thanks for the update on Gill. Have you or Rick heard of any movement in State of Mass vs HHS et al? It seems like I haven't heard anything about it in forever.
